I think we could all probably see this one coming. When the two children of Kelly Rutherford and Daniel Giersch came to stay with Kelly for the summer, we probably all wondered if she would put them on the plane back in August. She didn’t. In a confusing statement Kelly released on Friday she said that because no court in the US is claiming jurisdiction to send her kids away that there is no court who has jurisdiction to order her to send them away so she is keeping them in the US. Early this morning, Giersch said in a statement through his attorney that Kelly is guilty of child abduction and that she and any people who are helping her face the legal consequences of child abduction.
This is a crazy case. Giersch, a German citizen was deported when a member of Kelly’s team gave false information to Homeland Security. They thought it would strengthen their case but it didn’t. Instead, a judge ordered that the kids reside with their father in Europe. Giersch paid for Rutherford to travel each time to Europe and gave her money for expenses to fly, but she has always tried to find a way to bring them back to the US. In every instance, the courts have either ruled they don’t have jurisdiction or have confirmed the previous rulings which ordered the kids to live in Europe.
